By using the website, users agree to adhere to these terms and conditions, which govern the use of services, purchase transactions, and content provided.

- "IK" refers to "Immediate kin".
2. Registration and Member Eligibility:
- By registering/signup with Soukhya.Health , creating an account, and using the Services, users become members of Soukhya.Health. Use of this Website is restricted to individuals eligible to form legally binding contracts under applicable law, excluding those deemed incompetent to contract under the Indian Contract Act, 1872, such as individuals below the age of eighteen (18) years, undischarged insolvents, etc. Members are obliged to provide accurate, complete, and current information about themselves and beneficiaries at all times.
- Members contacting Soukhya.Health via chat, the contact us page, or any call-to-action forms on www. Soukhya.Health consent to receive Feedback Calls, Sales Calls, and promotional content. Registered customers using Soukhya.Health services acknowledge this consent. They also permit Soukhya.Health to use their registered phone number for WhatsApp Communications, including alerts and transaction updates. Furthermore, members authorize Soukhya.Health to utilize their testimonial pictures, and videos for marketing across various platforms. All the T&C applicable to the member are equally applicable and binding on its beneficiaries.
3. SAFETY AND SECURITY
- You are accountable for safeguarding your password and all activities under it, whether through our Service or a third-party Service linked to Soukhya.Health. Do not disclose your password or any other confidential information to third parties. Notify us immediately of any security breaches or unauthorized account use. Soukhya.Health is not liable / responsible for any data loss resulting from member negligence in password management, account and data protection.
4. Services offered
Soukhya.Health provides both bundled and personalized services, either managed internally or through external suppliers and that the range of services offered is not exhaustive and may vary. Soukhya.Health will offer all the Services outlined on its website or mobile portal, subject to the constraints and limitations of Soukhya.Health.

B. During your membership with Soukhya.Health , services will be provided as per your requests. However, Soukhya.Health reserves the right to decline services conflicting with laws or decency standards.
C. The services are valid for a specific duration. Once the service period ends, Soukhya.Health's responsibilities end. The member acknowledges that Soukhya.Health is not liable / not responsible for providing medical emergency assistance to the beneficiary after the plan expires, as the contract between the member and Soukhya.Health terminates upon the subscription's expiration. Recordings of correspondence may occur, and your consent is implied. Any communication involving Soukhya.Health , yourself, the beneficiary, or a third party about the provided services may be documented, and you consent to this.
D. Soukhya.Health aims to meet performance dates, but they are estimates only; time is not crucial unless specified. If a requested product or service isn't available, substitutes may be offered. You may at your sole discretion refuse acceptance of such substitute products and/or Services and seek refund from the Supplier/Service Provider if the payment has already been made to them for the unavailable product or Service. You acknowledge that Soukhya.Health may accept commissions for supplied products or services. For third-party services, agreements are between you and the provider, with Soukhya.Health not being a party to such agreements.
E.You acknowledge that any services provided by third parties result in an agreement for the supply of goods and/or services between you and the relevant supplier/service provider. Soukhya.Health is not a party to such agreements.
F. Soukhya.Health offers comprehensive healthcare assistance to its beneficiaries, subject to the terms and conditions outlined in this Agreement. In emergencies, Soukhya.Health strives to verify false alarms promptly but disclaims liability for delays or resulting consequences from such verifications.
G. Soukhya.Health commits to take the beneficiary to a specified hospital unless exceptional circumstances arise. It promises to prioritize the beneficiary's welfare based on the current situation, disclaiming responsibility for hospital decisions. Members acknowledge that Soukhya.Health isn't liable for emergency assistance unless beneficiaries provide necessary details for an emergency situation during registration. In emergencies, Soukhya.Health refrains from intervening if immediate kin or a third party has initiated action, until otherwise instructed or needed, but ensuring ongoing communication and assistance if needed. However, Soukhya.Health ensures the beneficiary reaches one of the designated hospitals if it has not been mentioned during registration.
H. Soukhya.Health is committed to providing emergency services and assistance to its members and beneficiaries on a priority basis. However, it disclaims liability for providing/not providing assistance to a third party along with the beneficiary and cannot be attributed upon Soukhya.Health. Members agree to refund all expenses incurred by Soukhya.Health for emergency services and facilitation.
I. Soukhya.Health bears no responsibility for any self-medication attempts or incorrectly ordered medicines by You. Soukhya.Health does not verify the medicines delivered to You. It is advised that You inspect the medicines, including checking the expiry date, upon delivery by the pharmacy.
J.The Member voluntarily consents to and authorize the rendering of elder care services, including routine services, diagnostic procedures, check-up, medications, laboratory services, nurse & attendant’s services and other services, including the use or potential use of restraint, which my attending physician or others holding clinical and non-clinical privileges consider necessary in person or telehealth. I understand that the practice of geriatric care services is not an exact science and I acknowledge that no promises or guarantees have been made to me regarding services or services rendered in this geriatric health care facility.
5.Terms of Use of services :
A.The Subscription Plan's Service starts within 72 hours of payment, prompting a Soukhya.Health team call to confirm elder details. The Service start Date activates Services upon confirming provision details, followed by written confirmation. Membership necessitates registration details provided to Soukhya.Health under T&C, which the Member unconditionally accepts. In cases of Member incapacity, Immediate kin assumes responsibilities, empowered to make decisions, including healthcare, on the Member's behalf. Soukhya.Health is authorized to utilize Your and the beneficiary's information for fulfilling its ongoing obligations. Soukhya.Health reserves the right to suspend the Services at any time if there is a breach of the T&C by the Member, their immediate kin, or any family members.
B.You can submit your request via Telephone or Email,. Before placing any Service order, carefully review its description and agree to the included conditions. If Soukhya.Health cannot handle a request, it will notify the member promptly. The member agrees not to engage third-party service providers without prior notification to Soukhya.Health.
C.The member acknowledges that services are limited to the Home limits, defined as within city boundaries from the member's address at the Service start date. Services will be delivered at the residential address provided during registration and within the designated Home Limits. For services beyond these limits, the member must notify us at least 48 hours in advance. We will confirm if services can be provided in the specified area, subject to availability. We are not liable for the unavailability of services beyond the specified area. The member commits to promptly report any alterations/modifications sought in the services rendered by Soukhya.Health's service providers accessed through Soukhya.Health.
D.The member undertakes to promptly notify Soukhya.Health of any alterations or modifications required in the Services offered by Soukhya.Health's Service providers through Soukhya.Health. Additionally, the member acknowledges the obligation to reimburse all expenses incurred by Soukhya.Health , beyond the booking and registration charges for individual or packaged Services, unless mutually agreed upon otherwise.
6. SERVICE PROVIDERS:
Soukhya.Health diligently selects Suppliers/Service Providers, but cannot be held accountable for their selection. Suppliers/Service Providers are solely responsible for providing requested Services, products, and benefits. Soukhya.Health acts as a liaison for third-party Services, arranging and facilitating communication. Suppliers/Service Providers may impose their terms, binding until Service conclusion. Soukhya.Health ensures quality and timely Services but disclaims responsibility for delays caused by Suppliers/Service Providers. Soukhya.Health holds no liability for accidents or damages caused by Suppliers/Service Providers during service provision.
.A The member acknowledges that they use the services at their own risk and discretion, being solely responsible for providing accurate and complete information, including medical history and updates. We do not authenticate or verify medical records but may maintain records of the member's clinical history. The member agrees to comply with all instructions provided by us. The safety of our team members rendering services at the member's house is the member's responsibility. Our services are subject to various conditions, including weather, city civic conditions, and Force Majeure events beyond our control.
B. The Member assumes responsibility for safeguarding personal property, money, and valuables. Additionally, they agree to provide basic necessities for Attendants / Nurses, including food, water, and sanitation facilities. The Member must conduct police verification for Attendants/Nurses and supply necessary supplies and equipment. Attendants cannot administer medications, and the Member must report communicable diseases promptly. They indemnify Soukhya.Health against negligence and ensure respectful behavior towards team members. Any harm caused to team members or Soukhya.Health's property due to Member or their immediate family and friends actions is the Member's liability. Members must comply with laws and regulations and acknowledge Soukhya.Health's non-liability for losses. These terms are governed by Indian law.
8. Payment & taxes
Members pay the subscription Fee in advance for the specified Services/ Plans at the time of purchase. Whereas, all the payments for the ancillary Services or additional services provided by third parties,at prevailing rates with applicable terms and conditions, shall be made by You to the credit of the third-party and Soukhya.Health shall not be liable in case of any dispute between the member and the third-party Supplier/Service Provider. The Member is responsible for paying all current and future local and Government taxes on the subscription Fee and other charges.
9. TERMINATION POLICY :
We, as Soukhya.Health , reserve the right to terminate membership at our discretion, with or without cause, providing 7 (Seven) days advance written notice to the Member. We may also withhold Services or terminate membership if the Member breaches these T&C, rules, or instructions, and fails to rectify the issue within the given timeline. Furthermore, we reserve the right to terminate membership immediately if the Member breaches clause 7 entirely or provides misrepresentations regarding Medical history or resources. Additionally, we may cease Services if We/Our team members /Attendants/Nurses cannot provide care due to undisclosed communicable diseases like COVID-19. Termination does not exempt You from paying for already booked Services or negate any existing liabilities. Upon termination, You lose access to the Website and all services will terminate, and all terms, indemnities, disclaimers, and liability limitations remain in effect.
B. Termination by Member: A Member has the right to terminate their membership at any time during the first month of the services rendered. However, after the first month, Soukhya.Health enforces a strict no refund policy. If Soukhya.Health is unable to deliver the services as per the Membership plan and the Member cancels, Soukhya.Health may refund the subscription amount on a pro-rata basis, subject to mutual agreement, within 30 days of the written cancellation notification.
10. CESSATION OF MEMBERSHIP- NON RENEWAL/DEATH/TERMINATION
A CESSATION OF MEMBERSHIP a) Non-renewal: Membership ends if not renewed before the Term expires. Services continue if renewed for the agreed period.
B. Death: Membership ends automatically upon the Member's death. Charges apply until Services end. For all membership plans for couple , if two Members reside in one household, Services continue for the surviving Member until Agreement termination or their death.
C. CONSEQUENCES OF TERMINATION No Services provided post-termination.
11. FORCE MAJEURE
We are not liable for any breach of Services due to circumstances beyond our control, including acts of God, pandemics, strikes, or government orders. During a force majeure event, if we cannot provide part of the Services, it will not be considered a breach on our part.
LIMITATIONS OF LIABILITY
A. As a subcriber, you acknowledge our commitment to providing Services in good faith, ensuring safety and suitability. However, we disclaim liability for direct, indirect, or incidental damages. We're not accountable for harm, loss of health, property, or life from actions not attributable to us, our team, affiliates, or partners. In case of liability, our responsibility is limited to the amount paid by you for the membership plan selected by you, deducted by the value of services provided until the liability arose.
B. Your contractual agreement for Services is directly with the relevant Supplier/Service Provider. Therefore, all your rights and remedies must be pursued solely against them. Soukhya.Health absolves itself of liability for actions or oversights of Suppliers/Service Providers, disclaiming responsibility for any resulting losses.
C. Soukhya.Health is not liable for delays or failures beyond its reasonable control.
D.Inaccuracies or mistakes by You leading to inconvenience or delay do not render Soukhya.Health liable, and losses incurred may be claimed from You.
E. This clause remains effective post-membership termination or Service conclusion.
13. Indemnity:
By utilizing our services, you agree to indemnify and hold harmless Soukhya.Health , its employees, directors, officers, agents, successors, and assigns from any claims, liabilities, damages, losses, costs, and expenses, including Lawyers fees, arising from your actions or inactions. This encompasses breaches of warranties, representations, or obligations under this Agreement, violation of laws or rights, and misinformation. This indemnity clause remains in effect after the Agreement's expiry or termination and your membership cessation with Soukhya.Health. Additionally, you release Soukhya.Health and its affiliates, staff, employees, and representatives from any liability associated with third-party service providers' actions or inactions, thereby waiving any claims under any statute, Agreement, or otherwise against Soukhya.Health in this regard.
14. MODIFICATION OF TERMS AND CONDITIONS
We retain the authority to revise or amend the terms and conditions, with notifications sent to Members through mail or mobile numbers provided at the time of subscribing. If no objections are raised within 3 (Three) days of the updated terms and conditions being displayed, Soukhya.Health will consider them as unreserved and unconditional acceptance of such modifications.
15. SEVERABILITY
Should any provision of these terms and conditions (in whole or part) be deemed illegal, invalid, or unenforceable, the remaining provisions shall remain fully valid and enforceable.
16. Miscellaneous
Users of Soukhya.Health's services must adhere to lawful purposes, abiding by terms, laws, and regulations. They acknowledge that using the website and engaging in transactions is at their own risk, necessitating prudent judgment. Users agree not to disseminate unlawful, abusive, or objectionable material through the website, nor disrupt others' use. They must refrain from acts breaching applicable laws and serve as the primary contact point for Soukhya.Health regarding its services.
16. Copyright
Soukhya.Health's website content, including text, design, graphics, logos, trademarks, audio, and video, is protected by laws. 17. GOVERNING LAW AND JURISDICTION
The agreement between Soukhya.Health and its members and beneficiaries is subject to Indian laws, with the courts in Hyderabad having exclusive jurisdiction over disputes. Disagreements about the agreement terms will first be resolved amicably; if unresolved, arbitration under the Arbitration and Conciliation Act, 1996, may be pursued with mutual agreement of the parties.
